Copyright Infringement Notification
How to Submit a DMCA Takedown Notice
If you believe that content on PopHop infringes your copyright, you may submit a DMCA takedown notice. To be effective under the DMCA, your notice must include all of the following information:
Required Information
1. Identification of Copyrighted Work:
- A description of the copyrighted work that you claim has been infringed
- If multiple works are involved, a representative list of such works
- Registration number if the work is registered with the U.S. Copyright Office
2. Identification of Infringing Material:
- A description of the material that you claim is infringing
- Sufficient information to allow us to locate the material (specific URLs, community names, product names, creator usernames)
- Screenshots or other documentation showing the infringement
3. Contact Information:
- Your full legal name, address, telephone number, and email address
- If you are representing the copyright owner, include your relationship to the copyright owner
- Preferred method of contact for follow-up communication
4. Good Faith Statement:
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
5. Accuracy Statement:
- A statement that the information in the notice is accurate
- A statement under penalty of perjury that you are authorized to act on behalf of the copyright owner
6. Electronic or Physical Signature:
- Your electronic or physical signature (typed name is acceptable for electronic submissions)
- If representing another party, proof of authorization to act on their behalf

What Happens After Submission
Initial Review Process
1. Notice Receipt (Within 24 Hours):

2. Validity Assessment (Within 48 Hours):
- Review of the claimed infringement and supporting evidence

3. Content Removal (Within 48 Hours of Valid Notice):
- Prompt removal or disabling of access to allegedly infringing content
- Notification to the user who posted the content

- The creator or user who posted the content is notified immediately when a DMCA notice is received
- Copy of the DMCA notice (with personal contact information redacted as appropriate)

Takedown Notification:
- Confirmation when content has been removed or access disabled
- Explanation of the removal reason and legal basis
- Information about appeal and counter-notification rights

Counter-Notification Process
When to File a Counter-Notification
You may file a counter-notification if you believe that content was removed or disabled as a result of:
- Mistake or misidentification
- Fair use or other legal use of the copyrighted material
- Permission from the copyright owner
- Public domain material incorrectly claimed as copyrighted
- False or bad faith DMCA claim
Counter-Notification Requirements
Your counter-notification must include:
1. Identification of Material:
- Description of the material that was removed or disabled
- Location where the material appeared before removal (URLs, community names, etc.)
2. Contact Information:
- Your full name, address, telephone number, and email address
- Username and account information on PopHop
3. Legal Statements:
- Statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification
- Statement that you consent to jurisdiction of Federal District Court for your address (or jurisdiction where PopHop is located if outside the US)
- Statement that you will accept service of process from the person who filed the original DMCA notice
4. Electronic or Physical Signature:

Counter-Notification Process
1. Submission (Email Preferred):

- Subject: "DMCA Counter-Notification - [Brief Description]"
- Include all required information
2. Review Period (Within 48 Hours):
- We review the counter-notification for completeness
- Verification that all DMCA requirements are met
- Assessment of the good faith nature of the counter-claim
3. Forward to Original Claimant (Within 2-3 Business Days):
- Complete counter-notification forwarded to person who filed original DMCA notice
- Notification that content may be restored in 10-14 business days

Repeat Infringer Policy
Three-Strike System
PopHop maintains a policy of terminating accounts of users who are determined to be repeat infringers:
First Violation:
- Content removal and warning notification
- Educational resources about copyright compliance
- Account remains in good standing
- Strike recorded on account for future reference
Second Violation:
- Content removal and formal warning
- Temporary restriction on uploading new content (7 days)
- Required acknowledgment of copyright policies

- Forfeiture of any outstanding earnings or payments
